In the state of Florida, it is illegal to operate a motor vehicle while your blood alcohol content (BAC) is 0.08% or higher. If you are arrested and your BAC is found to be at or above this legal limit, then you will be charged with the crime of driving under the influence (DUI). DUI can be charged as either a misdemeanor or felony offense, depending upon the factors involved in the case.

The penalties that you could face for this conviction may include up to six months in jail, fines up to $1,000, license suspension up to one year, and community service hours among other penalties for a fist conviction. With more convictions, the penalties increase. For drivers over the age of 21, the Florida BAC limit is 0.08%; however, if a driver is under 21, then the limit is reduced to 0.02%, and it is 0.04% if the driver is a commercial driver regardless of age.

Another issue to be aware of is the implied consent law in Florida. This essentially states that if you are driving on the roads in Florida, then you consent to performing a chemical test when asked. While it is your constitutional right to refuse this test, it is important to know that you will lose your driver’s license for one year for a first offense. Field sobriety tests are another matter; it is important to know that you may refuse a field sobriety test without fear of receiving penalties.
